These Terms and Conditions govern the use of Suweka’s services, including website design, development, and related support. By requesting a quote, purchasing a template, or engaging Suweka for a custom project, you agree to these terms.

1. Scope of Services

Suweka designs and develops business websites and online stores to help companies sell online and attract customers. Services may include UI/UX design, front-end and back-end development, content setup, payment integrations, and basic SEO setup.

2. Ordering and Onboarding

  1. Submit details via the Request a Quote form or select a template.
  2. We review your requirements and issue a proposal with scope, timeline, and cost.
  3. Project begins after written confirmation and initial payment (if required).

3. Pricing and Payments

  • Prices depend on design, features, and integrations requested.
  • Invoices may require a deposit before work starts and staged payments upon milestones.
  • All fees for domains, hosting, email, or third-party tools are billed separately unless stated.
  • Payments are due on receipt unless otherwise agreed in writing.

4. Timelines and Approvals

Delivery estimates depend on client responsiveness, content readiness, and requested features.

  • We provide milestones and request approvals at each stage.
  • Delays in feedback or content may shift timelines.

5. Revisions and Change Requests

Each project includes a reasonable number of revisions for items within the agreed scope.

  • New features or scope changes may affect cost and timeline.
  • We will confirm any changes in writing before proceeding.

6. Client Content and Responsibilities

  • The client provides accurate text, images, product data, and legal notices.
  • The client ensures they have rights to all content submitted.
  • The client is responsible for business compliance, taxes, and policies on their website.

7. Hosting, Domains, and Email

Hosting, domains, and email services may be provided by third parties. We can recommend providers or manage setup on request. Service uptime and email deliverability depend on the selected provider’s infrastructure and policies.

8. Third-Party Services and Integrations

Integrations (payments, shipping, analytics, etc.) are subject to the terms and uptime of those providers. Additional fees or accounts may be required. We will guide setup as part of the project scope.

9. Warranties and Limitations

  • Suweka delivers work in a professional manner and tests core features before launch.
  • We do not guarantee specific sales or search engine rankings.
  • We are not liable for losses caused by third-party outages, security incidents on client-managed servers, or misuse of the website.

10. Refunds and Cancellations

  • Template purchases are generally non-refundable once files or access are provided.
  • For custom projects, deposits cover discovery, design time, and initial work and are non-refundable.
  • If a project is cancelled after work begins, completed milestones are billed.

11. Intellectual Property and License

Ownership and usage rights are defined in the Suweka License Agreement.

  • Full payment is required before final delivery or transfer of access.
  • Clients receive a license to use the website for their own business. Resale or redistribution is restricted.

12. Privacy and Cookies

Personal data is handled as described in our Privacy Policy and Cookie Policy.

13. Support and Maintenance

Post-launch support and maintenance depend on your plan or agreement. We fix launch-specific bugs reported within an agreed period. Ongoing updates, content edits, or new features are billed separately unless included in a plan.

14. Suspension and Termination

We may suspend or terminate work or access if invoices remain unpaid, if there is misuse of services, or if there is a breach of these terms or applicable laws.

15. Governing Law and Disputes

These terms are governed by the laws applicable in Kenya, unless otherwise required by your local law. Disputes will first be addressed through good-faith negotiation.

16. Changes to These Terms

Suweka may update these Terms and Conditions to reflect service or legal changes. The latest version will be posted on this page.
